1. This Agreement
1.1. This agreement
This agreement is a legal document that describes your and khmer36.com Inc.'s ("khmer36.com", "we", "ours," your "," you "or" us ") rights and obligations in connection with the services as a khmer36.com provider through this site, or other other sites and / or services hosted by khmer36.com or other of the khmer36.com sites to which we have links (under one "khmer36.com service"). 1.2. The agreement in its entirety
This agreement includes:
i. The rules that apply to the different types of shops and store and city portals you access via electronic devices, and which allow you to enter into using khmer36.com city portals.
ii. khmer36.com personal data policy
These rules constitute the entire agreement between khmer36.com and you in connection with khmer36.com services and transactions, as they replace all previously entered into agreements and understandings between you and loceForum.
1.3. Changes to this Agreement
khmer36.com reserves the right to continuously amend this agreement and publish new versions of khmer36.comcom. When we do, we will inform you on the front page (www.khmer36.com.com) and in an email to you. The new version of these terms and conditions will take effect and apply to all trades as well as to any other activity on or via khmer36.com services as well as to your relationship with khmer36.com. The new version will enter into force four weeks after the date of its publication (or a fixed date by khmer36.com).
If you do not want the new version of the agreement to apply to you, you can notify us within the above 4-week period. From the day the new version takes effect, you must stop using khmer36.com services.
khmer36.com trading conditions are subject to change with immediate notice
1.4. Place of work and choice of law
i. khmer36.com is a company located in Cambodia with the address Sok San Road, Svay Dangkom Commune, e-mail: info@khmer36.com.com
ii. This Agreement and all transactions are governed by Khmer laws. All trades are considered to have been completed in Cambodia unless otherwise stated.
iii. You and khmer36.com are in principle both subject to the non-exclusive jurisdiction of the Khmer courts in connection with any disputes that may arise in connection with this agreement or a trade. Any disputes of a legal nature with khmer36.com as the accused party must be brought before a Khmer court
1.5. Your e-mail address
It is IMPORTANT that you make sure that the email address we have registered in your name is up to date and that you have full access to it. We use the address to send you important messages, including your invoices. If you change your e-mail address or mobile, you must update your profile at khmer36.com to thereby inform us and your customers about the new address or telephone numbers.
2. Other services
2.1. khmer36.com services in countries other than where you live
Each time you use a khmer36.com service in another country (eg through city portals), your use of the khmer36.com service will be subject to the terms and conditions applicable to that city portal and the country where the city portal has been created. Such terms and conditions will, as far as possible, be drawn up in the local language and may deviate from these terms and conditions so as to reflect the laws and practices of the country concerned. You should be aware that there can be big differences in what effects can be legally bought and sold in the different countries.
By using khmer36.com in other countries, you agree to the terms and conditions that apply to that country. If you have any questions regarding the terms and conditions that apply to khmer36.com services in other countries, please feel free to contact the relevant city-portal manager or khmer36.com customer service for further information.
Even if you enter into a trade via a khmer36.com portal and store set up from another country, you must be aware that you are still subject to the conditions that apply in the country where you set up the user, store or city portal.
2.2 Additional services
khmer36.com or affiliates may continuously offer you and other members non-trading services or benefits ("other services") through the khmer36.com service. Your use of such other services may be subject to additional terms and conditions or rules of use which you must comply with and are not listed here on the respective websites for these services. Failure to comply with any material provisions in the terms or conditions applicable to our other services will be deemed to be a material breach of this Agreement.
3. Registration
3.1. Registration
You undertake to sign up for khmer36.com services with your real name, address as well as any other related information you are asked to provide. In connection with a transaction made, you may be asked to provide details of credit card, debit card or customer card. In doing so, make sure that:
a. you are fully entitled to use the card both at the time you enter the requested information and when you try to use it b. that there are sufficient funds on the card to cover all charges made as part of your activities at khmer36.com. khmer36.com uses external players to handle online transactions and does not store your personal payment data
If any errors occur in any of the information you provide, please inform khmer36.com of the correct information.
3.1.1 Registration as a private or business member
When you sign up for khmer36.com, you must indicate whether you want to register as a private or business member. As a private person you can create "classified ads" and as a trader with direct purchase and payment options
You are considered to be a trader when you sell for more than one of your authorities' specified period of 12 months, or if you sell goods that are deemed to have been purchased with resale and profit in mind. In both cases, you are required to have the necessary permissions to sell online and be prepared to hand over this data to khmer36.com and / or authorities who request it. khmer36.com reserves the right to change your status from private to trading member at any time, without prior notice.
Both private and business members are obliged to comply with all applicable rules for Cambodia, including rules regarding the right of withdrawal for your buyers. This means that as a member who buys, may have the right to cancel their purchase for a period after they have received your item. This can be true whether you are dealing with a private or a commercial seller. Likewise, with a private seller, you also have the right to always pick up your item and pay in cash upon delivery.
Commercial seller using pickup shop facility is obligated to get bought items to the center shop for customer pickup. Khmer36 offers pickup services 1 time a day for each participating market in daily schedule. As commercial seller you can deliver sold items to this pickup van which will transport items to center shop. If not using this daily services, you are as seller obligated to get ordered item to Khmer36 center shop latest next day at 13.00
3.2. Other conditions
In order to enter into a trade, you must be legally entitled to enter into agreements for the purchase or sale of the goods in question
4. Personal data and personal data policy
4.1. Use of personal data

4.3. Member discretion
You agree not to make use of information regarding other members that is accessed by khmer36.com services or that you receive from khmer36.com or another member (including, but not limited to, the use of members' email addresses to spam or harassment) in addition to entering into and terminating trades through khmer36.com's services or as may otherwise be expressly permitted under this agreement, or as agreed with the other member.
5. Trading and trading conditions
5.1. Terms of trade
At khmer36.com, you have the opportunity to participate in trades that are subject to our trading rules.
khmer36.com trading rules describe how you can participate in trades and what guidelines are available in connection with this. We ask you to make sure that you understand the way in which the traders operate on khmer36.com city portals, and that these may differ from portal to portal depending on country and law - before you participate in a trade. As we develop the services we offer, we may continually change our trading rules, both to add (or remove) specific types of trades and to change the way trades are conducted. You should therefore always keep up to date with khmer36.com trading rules.
6. General trading rules
6.1. Relevant content
If you are a seller on khmer36.com, you are obliged to disclose the most important characteristics of the product or service in the space available, and you are obliged to limit the content of information stated in the product description or otherwise, to relate exclusively to trade theme and not irrelevant topics. This also applies to answers to questions from bidders.
This means that such information may not, for example, be used as a means of communication to one or more of the other members and may not be used to generally advertise or promote the sale of your other goods or services that are not covered by the trade. If you insert a link to another site in the item description, the linked site must meet this relevance requirement, but you acknowledge in any event that we are entitled to remove or require such links to be removed. Inserting a link to a site that does not meet this relevance requirement or poses a security risk to users or lociFrum constitutes a breach of this agreement.
6.2. Traveler rating
khmer36.com grading system allows you to comment on the goods or services that you have received from other members in connection with trades. You can only rate the members to whom you have sold goods or services or from whom you have purchased goods or services. All such statements must be accurate and fair and must comply with the applicable conditions for membership of khmer36.com.
6.3. Seller's full ownership
When you insert any item (item or service) into an advertisement, you warrant that you are legally entitled to transfer ownership of the item or service to the buyer.
6.4. The accuracy of quotations
You must describe the goods or services a given advertisement deals with, and which you make available via khmer36.com services - exactly. You are responsible for any errors or omissions in your descriptions. Brand names or other indications of origin or brand that you include on your listing must be completely accurate and must not mislead members.
6.5. Prohibition
As a seller, you are responsible for ensuring that neither the sale of the goods nor the services in the advertising you include them in, nor any activity or communication (including submission of a membership rating) that you make in connection with any trade
a. may infringe intellectual property rights or other rights of a natural or legal person
b. be a violation of applicable Cambodian laws, whether criminal, liable or otherwise
c. be offensive, threatening, linguistically abusive, insulting, defamatory, obscene, pornographic, false, unreliable or misleading.
6.6. Illegal goods
As an extension of section 6.5 (but without limiting the content of this provision), you may not offer for sale, buy or sell the goods or services listed on the authorities list of Illegal Goods and Services.
6.7. Correct use of categories
You may only place a product under the category to which the product belongs and into which the subject of the trade naturally fits (and not into other categories). Listing in the wrong category constitutes a breach of this Agreement.
6.8. Seller's terms and conditions
As a seller on khmer36.com, you are obliged to inform all actual or potential buyers of all the contractual terms and conditions that are relevant to the transaction, including information about the right of withdrawal and complaint.
6.8.1. Right of withdrawal
As a seller (whether you are registered as a private or business member) on khmer36.com, you will most often have to grant a right of withdrawal to your buyers, just as you are obliged to comply with the rules in force in any given country regarding consumer protection and deficiencies, including withdrawal and the right to make a complaint, which rules may apply. In addition, you must state any right of withdrawal in the item description, and must also inform the buyer in writing of any right of withdrawal when you contact the person, after a purchase has been made. 6.9. khmer36.com intellectual property rights
As a member of khmer36.com, you acknowledge that all copyrights, trademarks and other intellectual property rights in and relating to khmer36.com's services are owned by khmer36.com (or its affiliates). You may therefore only make use of these intellectual property rights or khmer36.com services to the extent necessary to create a city portal, store or products, enter into trades and carry out other permitted activities as provided in this agreement. khmer36.com reserves the right to use users' own images in connection with the promotion of khmer36.com and activities thereon.
6.10. No right of withdrawal
The service we provide salespeople is to post their stores and goods on khmer36.com. You acknowledge this and that you do not have the right to regret the purchase of services from khmer36.com that are tailored to you. 6.11 Purchases and sales via khmer36.com mobile apps
khmer36.com gives its members access to offers and content on khmer36.com via mobile devices and provides the opportunity to submit purchases and enter into trade agreements through these mobile devices. khmer36.com reserves the right to exclude certain content, services and features that may only be available by computer access.
khmer36.com offers its members selected solutions via mobile devices. The use of these applications is subject to consent to a separate licensing agreement.
khmer36.com reserves the right to technically edit, modify and adapt offers and content of a listing of a product or service so that they can be viewed on mobile devices.
As a member, you acknowledge and agree that the presentation of portals, shops, goods and services via mobile devices may differ from the description due to technical limitations on your mobile.
As a member, you accept that purchases made via a mobile device are binding in the same way as the bid made via a computer or tablet.
7.2. VAT
The prices of all goods or services must follow the applicable taxes and VAT rules for a given country where khmer36.com has a city portal. Prices are basically including these taxes and VAT, unless otherwise stated by the seller.
8. khmer36.com role
8.1. khmer36.com role
khmer36.com basically has no party to trades on the site. However, in connection with charity or other special offers, we can act as a seller. In addition, we can offer services to help set up online stores and listing products and services. If and when this happens, it will be clear that the transaction is with khmer36.com. In all other cases, khmer36.com only makes the technical aids available in connection with the initiation or execution of the transactions. Here, we are neither the seller nor the supplier of the goods or services listed in the listings and are thus not subject to any of the legal obligations that apply to you who sell or buy goods or services via khmer36.com. khmer36.com is not and cannot be held responsible for the behavior of you or other members or for the goods or services offered for sale or delivery - whether it is a trade between private individuals or between private and traders.
khmer36.com and city-managers have no control over and are not responsible for the quality, safety or legality of the goods or services offered for sale through our services, for whether the advertising is accurate and correct, for whether you as a seller have the will and ability to deliver and sell these goods or services, or whether you, if you buy, have the will and ability to pay for it. khmer36.com does not pre-screen manager-driven city portals, stores, goods or the covered goods or services. Likewise, khmer36.com, can not control the termination or validity of made trades. Although prohibited, some members may provide information, or otherwise engage in unreliable, unlawful conduct, or otherwise breach of Members' obligations under this Agreement. You should therefore exercise as much caution when participating in the trades - whether you are a seller or a buyer - as when entering into similar trades outside the Internet.
8.2. Lack of access to khmer36.com services
We do not guarantee uninterrupted, continuous access to khmer36.com city portals. You acknowledge that khmer36.com services may be unavailable from time to time, whether scheduled or random, and that we may not be held liable for any lack of access.
8.3. Withdrawal of ads / trades / services / portals
As a member, you agree that we are entitled but not obligated to withdraw a listing or trade entered into which - based on information we have received from third parties or other members - appears to be a breach of this appointment. khmer36.com also reserves the right to withdraw advertisements, close a trade, extend a trade, terminate trades or terminate entire services where we have compelling legal or technical reasons (including technical difficulties affecting khmer36.com, or you or another member has experienced on our portals). If practicable, we will give you reasonable notice in advance of all such steps taken by khmer36.com.
8.4. Abuse of khmer36.com services
khmer36.com reserves the right to suspend, terminate and close your account, store and / or portal, which is or appears to us to continue, repeated or material breaches of the provisions of this agreement (including, but not limited to, that you have provided false registration information or otherwise misused khmer36.com services), and to discontinue or cancel transactions associated with such accounts. If your account is terminated or terminated, you may not re-sign up for khmer36.com's services without our prior consent.

We encourage you to use and pursue this opportunity which ensures a good trading platform for the benefit of all.
9. khmer36.com responsibility
9.1. khmer36.com RESPONSIBILITY
To the extent permitted by law, you shall indemnify khmer36.com, its Managers and employees for any liability that may arise as a result of or in connection with an advertisement, store or trade, including (but not limited to) all claims in connection with listings, unfinished or completed trades, or goods or services offered for sale or delivery, or actually sold or delivered, through or in connection with an advertisement or trade that you have created, bid on or traded around.
9.2. Force majeure
khmer36.com is not responsible for non-fulfillment of our obligations under this agreement, which is due to circumstances over which khmer36.com does not control and which khmer36.com should not reasonably have foreseen or overcome.
9.3. Maximum liability
Without limiting the content of the foregoing provision, khmer36.com's liability under this Agreement (whether due to negligence or otherwise) may in no case exceed the higher of the following amounts, either:
a. USD $ 200.00 or b. an amount equal to the amounts paid or to be paid by you or to you in connection with the service khmer36.com has offered - e.g. as payee and intermediary, and to which the liability relates, regardless of the basis of the action or the form in which it takes place. This limitation of liability does not apply if you act as a consumer
9.4. Exemption from liability
khmer36.coms is not liable to you or any third party for indirect loss or damage or consequential damages, for loss of data, profit, income or business, regardless of how these may have arisen (whether as a result of negligence or breach of this agreement or otherwise ). This limitation of liability does not apply if you act as a consumer.
You are responsible for the use and sale of other people's texts, images, music and video files, etc. at all times comply with applicable law, and that all forms of intellectual property rights are respected and remunerated in accordance with the rules laid down at any time. khmer36.com therefore disclaims responsibility for violations of the stated rights and forwards any inquiries about this directly to you.
9.6. Compensation
You undertake to indemnify khmer36.com for any liability, claims and expenses that may arise as a result of your breach of this agreement or due to your account with khmer36.com.
10. Other provisions
10.1. Transfer
khmer36.com reserves the right to subcontract or assign part or all of our rights and obligations in this agreement to subcontractors and managers of city portals. If we exercise this right, we must list the name of the rights recipient or subcontractor on the front page of a given city portal and you have the right to terminate this agreement immediately. You may not assign or dispose of this agreement without the written consent of khmer36.com.
10.2. Invalidity
If one of the terms of this Agreement is deemed invalid or unenforceable by a judgment or order, the remainder of the Agreement shall remain valid and enforceable.
10.4 Retention of the Agreement
We do not store copies of the agreements we enter into with you or other members when you sign up for khmer36.com services. You can access your agreement at www.khmer36.com.com. We advise you to print a copy of this agreement and / or save a downloaded copy on your computer.
10.4. The language of the agreement
This agreement has been prepared in English. The agreements applicable to khmer36.com services directed at another country are, as far as possible, drawn up in the language used in the countries to which the specific khmer36.com services are directed. It is a given khmer36.com Manager's task to ensure the portal's users access to khmer36.com's trading conditions in the language in which the Manager wishes to operate a city portal
11. Termination of membership
11.1 Termination
You can terminate your membership of khmer36.com's services at any time. Withdrawal does not release you from your obligations as a seller or buyer in relation to ongoing or completed purchases.

1. Introduction
The following terms and conditions describe the following:

These trading rules are legally binding and are part of your agreement with khmer36.com. By participating in a purchase, you acknowledge that you have read, understood and accepted these terms and conditions.
khmer36.com reserves the right to continuously change and adapt these trade rules to match current legislation in the countries where khmer36.com operates, either to add new policy measures and regulations, as well as the way in which sales and payments are implemented. You will be notified via your associated email if khmer36.com's terms and conditions change. khmer36.com encourages you to read these trading rules before opening a khmer36.com city portal in your own city or store in a given khmer36.com city portal. Even if you often buy or sell online, we recommend that you still take the time to read them. When you participate in a purchase or sale, you indicate that you have read and accepted them.
These trading rules must be read in conjunction with khmer36.com's terms and conditions. If there are any inconsistencies between them, khmer36.com's terms and conditions, which provide a more detailed description of your rights and obligations, take precedence over these trading rules. Terms used in these trading rules have the meaning given to them in khmer36.com's terms and conditions.
2. Buy
With the exception of the case listed below, all purchases made and made will be binding. This means that if a purchase is made through your khmer36.com account (whether it is from you or from someone who uses your account with your consent), it may not be revocable and is legally binding. 4. Prices
As a Seller and / or Manager, you must pay the following fees:
i. Monthly fee for renting online store or city portal

iii. Manager Success Fee, which is a fee paid when your city portal starts to take off and is used solely to provide new city portals on the map for the benefit of all partners.
As a buyer, you have to pay the following fees:
i. Any fee for using khmer36.com as a payee and intermediary in a given transaction
7. General trading rules
As a member, you should be aware of the following general rules:
i. khmer36.com reserves the right, with or without prior notice to the bidder / seller, to remove goods that violate applicable laws and trade rules or khmer36.com's terms and conditions.
8. Special trading rules for sellers
As a salesperson and / or manager at khmer36.com - you are subject to certain obligations:
i. Your listing must be accurate and legally correct and must include a description of the most important characteristics of the product or service.
ii. You must be entitled to sell and transfer the goods or services to the buyer that you offer on khmer36.com.
iii. You must accept that the listing obliges you to sell the goods or services offered on khmer36.com
iv. You may not attempt to sell prohibited goods, cf. khmer36.com's terms and conditions and the list of prohibited goods and services which you will find at the authorities in the country where khmer36.com, through the manager, operates a city portal.
v. No unnecessary additional costs for shipping and the like may be charged. at offered auctions.
9. Agreements with binding period
Be aware of any rules on the right to terminate agreements on ongoing services, etc. Possibly a given consumer can terminate an agreement with up to 1 month's notice until the end of a month when 5 months have elapsed after the conclusion of the agreement.
Regardless of which agreements may have been entered into previously, the applicable rules in the country where khmer36.com operates city portals cannot be deviated from.
10. Right of withdrawal
Are you a buyer?
When you buy an item from a private seller on khmer36.com, you as the buyer may have the opportunity to cancel the purchase, unless the agreement is exempted pursuant to separate rules for selected products and services. The right of withdrawal takes effect from the moment you make a purchase and is valid until a period specified by your authorities after the buyer, or a third party specified by the buyer, but not the carrier, gets the item in physical possession, regardless of whether you receive your item, or you pick it up yourself. If you want to cancel your purchase, you must request this in a statement to the seller. This can be done by writing directly to the seller or using our built-in refund contact. Be aware that you may have to arrange a refund for the item with the seller. You can NOT be reimbursed the purchase price by khmer36.com unless you use khmer36.com as an intermediary and payee for a fee. Also note that postage costs for sending the received item back to the seller are paid by the buyer, who must send the item to the seller no later than 14 days from the date on which the seller has received the buyer's notice that the buyer regrets and resigns from the agreement.
How do you exercise any right of withdrawal?
- If you wish to make use of your right of withdrawal, you must notify the seller, which can be done by using khmer36.com's built-in refund function, which puts you in direct contact with the seller.
- Please note that you must arrange a refund for the item with the seller. You can NOT get a refund of the purchase price from khmer36.com, unless khmer36.com is chosen as an intermediary and payee in a given transaction (for a fee).
Selling
When you as a user of khmer36.com (regardless of whether you are registered as a private member or a business member) offer a product or service, the buyer will in most cases have the right to cancel the transaction. However, there are exceptions to the right of withdrawal, e.g. when purchasing transport and accommodation, if it has been agreed on which day or within which period the service is to be performed.
Any statutory right of withdrawal runs for a period specified by your authorities, from the time the buyer has received the goods, or by services, for the specified period from the conclusion of the agreement, if you as a seller on paper or on a durable medium have informed about the right of withdrawal. If you first provide this information on paper or a durable medium later, the deadline will not run until it is received. In that case, the right of withdrawal may expire within the period specified by your authorities, after the day on which the information has reached the buyer, however with a limited time horizon after the buyer has received the goods or services. It must be stated in your listing whether you are a commercial and registered store owner (indicating that you are a trader and trade within your business). As a seller, you are obliged to disclose the right of withdrawal if the agreement is covered by this.
Are you a private seller?
As a private seller, you must comply with applicable laws and regulations in the country where khmer36.com has portals, as well as the buyer's right to possibly cancel his purchase. Any right of withdrawal takes effect from the moment a purchase is made and is valid until one of your authorities' specified period after the item has been received by the buyer.
